I think those folks are outside the scope. If they attack the local US embassy and the host government declines to detain them, what do we do? How are they classified? That's what the system needs to work on, among many other things. Since 9/11 the entire focus has been to use the existing laws of war where they probably don't apply, then scream at the critics how this is another existential WW2 conflict that justifies it all. That position is finally crumbling into deserved obsolescence.
