More nonsense!

If he served tainted beef he would have no customers because no one wants tainted beef. It's dangerous and "everyone" agrees they don't want it. That's why it is illegal. Smoking is still legal despite being dangerous. Many people choose to smoke despite the danger because they enjoy it (just like drinking, gambling, having unsafe sex etc....)
