If things were done properly and it was a smoking establishment you probably shouldn't even be there. You should be across the street at the non-smoking restaurant.

If it was a smoking restaurant and you chose to be there anyway, then you could politely ask the person to blow the smoke the other way, but that's about it.

Obviously not.

In your example, the non-infected person has no choice in whether or not to engage in sex despite the HIV risk because he doesn't know. There is no sign that tells him whether his potential partner is HIV positive or negative (smoking or non smoking)
