There is always the spot market. But, if a refinery cannot deliver on their contract, well, they are screwed. Such is what makes lawsuits.

If they have a contract? Most definitely. That means they have predicable costs.

Look, I have done work for several independent refineries. They live and die by contracts. For example, much of Roundup is produced, or at least was, by Texas City Refinery. Given that they are now owned by BP, who knows?

The fact of the matter is they need to have contracts to survive. The spot market is very hit or miss.
