I have no problem with a court deciding, though I don't think our civilian legal system is suited for folks like him. I doubt he was read his rights and provided an attorney when caught. I don't think we want lawyers for terrorists to have the same discovery rights for evidence that civilian criminals have - that would be a real problem for our intelligence agencies.
