I see the DNC is pushing the idea that one of McCain's torturers saying he would vote for McCain is the same thing as Hamas endorsing Obama.

The whole "original intent" notion is kind of whack anyway, as proved by the slavery compromise. It was a different time, and what was "intended" then might not apply now.
