>i do believe that a subset of private property rights should be regulated, though. specifically, those properties that serve the public. my guess is that this is low single digits of all private property, so your statement is about 1900% too broad.<

As far as I am concerned, one regulation that impairs the freedom of many people is too much, let alone hundreds of thousands of restaurant, bar, poolroom, and bowling alley owners and customers. It the principle, not the count.

>you merely draw the line before smoking while i draw it after smoking.<

I draw it at the point that doesn't impair freedom.

You draw wherever you see fit based on your personal preferences.

>and you are the one who decides everyone with a sound mind is?<

NO.

I don't think anything too elaborate is required. There are tell tale signs. The last thing we'd need is a government institution trying to figure out who is of sound mind.

If there is a legitimate debate in the public arena between two sides representing many people, it's already clear who is trying to restrict freedom.

>so everyone who supports a ban on smoking is a fascist? <

No. But everyone that supports government control of things depending on their personal views is exhibiting the kind of fascist/totalitarian tendency that leads to political correctness, reductions of liberty, political conflict etc...

That kind of behavior was very common in Nazi Germany, the Soviet Union etc...

Just thought you'd like to know that Hitler was wildly anti-smoking, had an active anti smoking campaign (something I would approve of), and put all sorts of bans on smoking in place. He was demonstrating a political philosophy that can easily be extended to lot of things that would make you miserable.
