What do you mean by that?

In both the 2nd amendment and those other examples there isn't any requirement being put forth.

In the others there isn't even anyone arguing that the non-active clause is making a requirement.<<

Requirements was the wrong word. I'll use yours - justification.

You want to argue that in the absence of the justification, the right should still pertain. I don't see how any of those examples show that to be true, since the justifications in all the other examples are still valid today.
