Re: "Without that assumption there is no reason to challenge McCain's eligibility."

LOL!!!!!!!!!

(You be doing a Hell of a lot of ASSUMING there! Anyway, for the record, I disagree with this particular claim of yours that there is 'no reason at all'... for the reasons I have already given, and for the many times I've said that the issue is a bit more complicated then you prefer to see it as.... No need for us to continue a 'cat fight' over this particular claim any further though, since it is merely opinion. Your opinion is that there is 'no reason to challenge', and my opinion is that there might be. Still, since neither of us are on the Supreme Court, and capable of resolving these 'opinions' into new-born legal facts... it shall just have to stay as our respective, and differing, opinions. :-)

Re: "So Chin seems to be saying if McCain was born on the moon that he would be a natural born US citizen, because the moon was beyond the limits and jurisdiction of the US, but since Panama was only beyond the limits but not beyond the jurisdiction, the previous law did not apply."

No. You misunderstood his argument.

He never said (that someone born under such circumstances - such as the 'on the Moon' that you posit) would be "NATURAL BORN".

As a matter of fact, he said exactly the opposite.

(Though, for the other-half of the phrase, as I've long pointed out: ANY CHILD of two American citizens is born as an "American citizen".)

Re: "No one has standing."

That would be a Hell of a thing, eh? No American anywhere would have legal standing to challenge if a candidate is legally qualified to run for President.... :-)

(But, like I also always said: there most likely isn't a Court in the land with guts enough to wade into this particular mine field. Though there *is* at least one suit that has already been filed, I expect all Courts to --- with great dexterity --- dodge this question at all cost. <GGG>)

Re: "thank the NYT for clearing up the ambiguity about if the 1937 applied retroactively. It DID. It applied to anyone born in the canal zone after 1904."

First I've heard of that.

If TRUE (& legal) it would certainly cover the circumstances of McCain's birth, and remove all doubts about his Presidential eligibility.

But --- I *thought* that the US Constitution had a rather firm BAN on ex post facto laws?
