Something being left unsaid in all this hulla-balloo over NSS in the financial stocks is that if the SEC is finally recognizing the illegality of NSS, then it is required to prosecute it EVERYWHERE it occurs.

And if they prosecute it, it opens up the legal "discovery" process to public scrutiny and the evidence where Broker/Dealers effectively counterfeited shares.

And if opened up to public scrutiny, it opens up Pandora's box with regard to civil class action lawsuits.

But even more important, it absolutely undermines the public's perception of the integrity of the equity markets (which many older folks are already leery about).

Legally speaking, the SEC cannot just limit their "emergency rule" over NSS to just financial stocks without making themselves an accomplish to the NSS in every issue on the Reg SHO list. I dare say the SEC commish has privately told the B/D's to clear up the NSS liabilities on the Reg SHO list immediately. IOW, police yourselves before the SEC/Justice's hand is forced into doing it for them (with badges, subpoenas, and handcuffs) with the corresponding high level of very unwanted publicity.

This has become a real hot-button issue (FINALLY). And I don't see it merely ending with the Financials.
