It may be that the Nevada decision will invalidate the current proxy, but I am not 100% certain of that. Ensure that you vote this one, but don't be surprised if another proxy finds it way to you.

More re: the proxy...

I just received the paper copy from another broker that holds some ACII stock. It's pretty much the same as the online form except for the option you use to vote for some, but not all, of the four Directors. If you wanted to use this option, you would place an X in the box that says "WITHHOLD AUTHORITY TO VOTE FOR ANY INDIVIDUAL NOMINEE. WRITE NUMBER(S) OF NOMINEE(S)BELOW." Then you would write the corresponding Director number on the line for the guy(s) you DON'T want. e.g. if you wanted the three newer guys to stay and Walther out, you would write the number "01" on the line to vote against Walther.

PS Make sure you sign and date the form if mailing it.

PPS The paper copy gives you a web address to vote online if you'ld prefer not to mail it, the URL is:

proxyvote.com

You need to input your control number which is a 12-digit number found on both the left and right side of the proxy. It's in the format "xxxx xxxx xxxx". If you go online and do it, the voting options are as I explained in the previous post. Apparently at my other broker, I elected not to recieve paper proxies so they sent me straight to the online site and entered my control number for me.

nwest: I hope this helps you out. There are only two items to address, it's pretty simple.

Barkley, I voted through my broker online as well and I with held my votes from all the names(255,000 shares). If VV6000 is correct, then those 70 million shares issued after May 1 will not count in the vote.
Has anyone gone by the ACII plant to see if it is still running a crew inside? I hope that the Eaton contract has been finished.
