Looks like AMD is getting a nice speed boost from 45nm, given the 4ghz clock speed being seen in (overclocked) samples: aceshardware.freeforums.org

It may be that Intel is finding itself in more of a horse race than any of us expected - especially considering that 2.5ghz Opteron beats 3ghz Xeon in typical server loads, and that Xeon doesn't scale beyond 2 sockets (unless aided by IBM technology and augmented by an IBM chipset).

It's hard to demand something that's being prevented from being offered and that's what is unacceptable to the EU.

If it's being prevented from being offered it's the computer manufacturers that are doing it. Intel doesn't have that power. The manufacturers see better profits in offering Intel products. It's really not that complicated.

There you go again. It's not like Intel kept EVERYONE from offering AMD parts. There are plenty of outlets available for AMD.
