actually that's not even a possibility here. phud stated that intel compensated him for his services. so he's either getting a personal check and a 1099 at the end of year or a check to his corporation. ie he's a contractor and intel doesn't have to pay ssi and other taxes for him to the irs. that's the only difference between an employee and a contractor. for all other purposes outside the tax law, he was in the employ of intel. a reasonable non-tax-related discussion would name him an employee.
