Dear Honorable Judge Lynch:

Plaintiff Securities and Exchange Commission and counsel for defendants George Sandhu and Mark Neuhaus jointly request an extension of the current August 15, 2008 deadline for the submission of papers to the Court concerning ccnain pending relief issues in the above- referenced case as to Sandhu and Neuhaus. In November 2007, Sandhu and Neuhaus consented to a bifurcated settlement of the action, pursuant to which the Court issued injunctive and other relief as to them. The bifurcate& settlements left open the issues of disgorgement and civil penalties as to Sandhu and Neuhaus, which comprise the only remaining relief sought in the Plaintiffs complaint as to them.

In May 2008, the Court granted the parties joint request to submit papers on August 15, 2008 on the remaining relief issues, and the defendants Sandhu and Neuhaus to submit responsive papers September 5, 2008 to submit responsive pleadings, and the plaintiff's reply to be due on September 19, 2008. We require additional time to review Mr. Sandhu's materials and to take an asset deposition from Mr. Neuhaus.

The parties jointly request that the Court extend the date for the submission of the plaintiffs pleadings to November 7, 2008 with defendants Sandhu and Neuhaus having until November 21, 2008 to submit responsive pleadings, and the plaintiffs reply to be due on December 5, 2008.

As grounds for the requested extensions, the parties represent that they are engaged in ongoing negotiations concerning a possible resolution of the remaining relief issues. The proposed extension will enable the parties to attempt to reach a settlement as to the pending relief issues.
