No. I think you implied the fund covered the liability of a company that spilled something. Not the case - see below:

..the owner or operator of a facility from which oil is discharged (also known as the responsible Party) is liable for the costs ...

The owner or operator ... not the government fund.

Where would the fund bear the liability? Off the top of my head, when the owner or operator is unknown or insolvent.

However, the fund is itself financed by a tax on the industry.
