How does law change anything in this context?

Not only is the US government both sides of the deal, its also the one that makes the law. It can call it whatever it wants but it doesn't effect the reality. The net effect for the government is the same whether the balance of the fund is $0 or some astronomical number. The last can't change this reality any more than King Canute's law could hold back the tide.

Actually even less because as impossible as it would seem to effect the tide its a physical event witch enough power and wealth and technology could effect, while the point about their not being a real trust fund is simple mathematics, which we can't change.
