The problem is there are so many scenarios that could be calculated, and on some of them he would be right, at least if you follow his setup and ignore state income taxes, and don't count a pro-rates share of corporate income taxes.

He might even try to get away with counting capital gains income towards the base, but not counting capital gains taxes towards the percentage paid because he said "including income and payroll taxes", and might argue that "capital gains taxes" are a separate category. There are all sorts of ways for him to manipulate this to make sure that he "wins the bet".
