AFAIK, that is up to the Republican party. So there probably aren't any legal issues.

It would be hard to interpret that as anything but desperation, though.

For all their circusy atmosphere, there is a legitimate [legal?] reason why there are conventions.....its to nominate candidates by the party's delegates from the states. So then, if the GOP decided to make the VP candidate the presidential candidate because she's more popular, I suspect there would be a significant uprising by those states' delegates and probably would derail the campaign.
