Yes,but not all the assets? Their was a law enacted 2005 that effects Lehman LEHMQ unfairly. To what extant this might prove a relevant argument remains to be seem. Surely the common that traded as high as (.25 cents) today and closed at (.215) after closing yesterday at (.051) has predictive implications. Yes,the Shitly devised Short covering rule had its effect as well with the rest of this insane market but their appears to be more viability here in content and expectations. Seeing Lehman trade over .50 in the next week will not surprise me in the least. What gives the who the right to decide what institutions or not survive,or should I say what shareholders get to survive while Lehman gets to pass away? This is the argument. This is not a level playing field. Do not expect the Court's action and possible intervention,already completed and the intervention yet to arrive,to be anything less than extraordinary in breath and scope. This is history in the making. They will be teaching what happens here for years to come and having to explain why an institution with 175 years or so of life had to evaporate into infinity because the government could not justify its existence against all others they judge as viable and worthy of survival.

May well be true, but the beneficiary will not be the LEH shareholders but the Trustee in Bankruptcy who is charged with realizing value from the estate. Can't find fault with that.
