In theory. The problem is in the reporting - that is, underreporting - during a down economy. People are less apt to complain about the 'extra' minutes and hours, and less likely to file a complaint. Basically, the balance of worker to employer tips in favor of the employer, and they take advantange.

Similarly, employees tend to slack off when the economy is good - they figure they can get a job anywhere.
