Immigration law has been a hot topic area over the past couple of years; e.g.,in the area of illegal aliens or people seeking asylum due to persecution in their home countries.

I receive email every day with the new cases decided by the CA courts and Federal 9th Circuit. There are an amazing number of cases concerning whether aliens should be deported to their home countries due to claims of persecution. My impression is that some of the Immigration judges are not particularly sympathetic to some of these claims, but the 9th Circuit, which is pretty liberal, frequently overturns.

What I haven't seen is a case where criminals or suspected terrorists are allowed to stay or enter the U.S. based on claims of persecution in their home countries. I do think that a situation like this warrants some extra time to consider the situation.

That underscores the kind of damage a President can do in appointing liberal judges to the federal bench. Ricardo Urbina was a Clinton appointee.

If Obama wins the election, I would expect that soon after taking office, he will close Guantanamo and simply release the majority of those held there. Some few that represent a threat that even Obama cannot dismiss may be transferred to other countries or remain detained.
