Speaking of thinking like a criminal.... The more I think about this CDS settlement thingy, the problem is only if the counterparties want to honor the contracts. What if they don't have to? I think this problem will be solved with an emergency order by the President and other governments in making several of the CDS contracts invalid - especially the ones written for those who don’t own underlying debt. Sure, it will screw some of the buyers, but it will prevent a systemic meltdown.
