Hell... there has been no action yet. Not even the first discovery conference... no rulings from the bench yet... nada. (And you are already getting worked-up about 'legal strategies'?) (My guess - and it's just that: an uninformed guess by an outsider - would be that, with dynamite being tossed around in the verbose filing and long, long, long laundry list of 'demands'... that the court and respondents are just being careful to cross their T's and dot their I's and not screw anything up.) <g>
