It's an argument from common sense.

IOW, there is no rationale. As expected, it's just the way a proposed anomaly can be made to fit into your world view.

Assuming for the sake of argument that utility was just the way the two of us unconsciously framed fairness, then what other ways might others with a more conscious awareness of fairness approach it? What alternative approaches to fairness would you recommend for couples divorcing?
