I admit that I am not conversant with this area of the law.
I do know this:

The status of the detainees at GITMO is in itself a complex legal question. Are they prisoners of war, enemy combatants,or some hybird status. I believe some are citizens. Each of these categories are entitled to different rights.

The supreme court has addressed these issues at least 2x and to the best of my understanding from press reviews and not from my own reviews of the cases I understand that they held that some of those detainees are entitled to Habeas Corpus hearings to determine if they are properly held, but did not determine that any were being held illegally, as I recall.

I have attempted some legal research into the issues involved and can only say that it would takes weeks, if not months, of research, for me to understand the issues involved. This is not as simple as you seem to think it is.
