This is a really stupid claim. Not only is it untimely, it is a tough case to make in that the Court granted cert, so with whom are you going to argue?

The Court granted certiorari, Congress had not acted to limit the Court's jurisdiction in the matter, and that's pretty much that. Congress could have acted in the matter and taken jurisdiction away from the Court but failed to do so. Without Congressional intervention, the jurisdiction is de facto.

These guys will never get over having been defeated in 2000. Here we are, eight years hence, they got their socialist elected, and they still want to re-argue the Bush presidency.
