Absolutely right. But the constitution gives the President the authority to veto spending legislation. Also, while the president can't spend money without authorization, he generally doesn't have to spend appropriated money unless specifically mandated by Congress... earmarks.

We'll see how Obama handles it, but Bush wasn't inclined to use his veto very often.
