In England malpractice "complaints" are reviewed by a judge before they can be filed.

And only specialized attorneys are allowed to file suits.

And the suits are ultimately against "the government" since it is a nationalized system.

Just requiring the cases to be reviewed by a judge would probably eliminate more than 95%
of the cases in the US, IMO.

In continental Europe there is a special panhandler for such malpractice cases the so called "Patientenanwalt" - patient advocate. Only thing is that those are not independent but paid, supervised, and instructed to keep compensations low by the hospitals. It is really tough to receive a compensation even in well documented cases and those are for token amounts. Example: After having had a surgery my mother fell into a life threatening allergic condition because of unsuitable medication; even though it was documented that she must not receive the prescribed medicine but a different one; as a result she was treated further four weeks in the hospital; a pittance of about $5K or so was offered .
