Equal protection of the law, doesn't mean every thing is treated the same. For example despite the fact that the military is part of government it doesn't stop the military from keeping women out of direct combat positions, or "don't ask don't tell", or different fitness standards for men and women. It doesn't forbid the government from banning polygamy, setting age limits for marriages, or otherwise defining marriage and who can participate in it.

But that's as a matter of constitutional law. As a political and ideological principle, it could be used to get rid of all sorts of things, including restrictions against gay marriage, or anything I list above, if people view it as applying in that way.
