It is becoming common to do both. Lots of people have done a religious ceremony with witnesses and formal documentation, only to find out the paper is worthless if you need to authenticate your marriage for some government entity, especially if it is a foreign government. So you go in front of a Judge and he marries you (Unites you legally). You can have that document entered into county clerk's records and bingo you are legal everywhere. The second step could easily be classified as a Civil Union instead of marriage. I know that because I know non-citizens who had to prove to their National Government they were married in America. That is what they had to do.
