Hearsay is commonly misunderstood. It is defined as a "statement, other than one made by the declarant while testifying at the trial or hearing, offered in evidence to prove the truth of the matter asserted."

If you testify "Cuban told me ..." that's hearsay, unless an exception applies.

If you testify "I told Cuban ..." that's not hearsay, because the witness is the one who said it, and he can always testify as to what he said.

Then it comes down to who the jury believes.
