The role of the courts is to override public opinion? Yes, its true the majority doesn't always do whats right. But how can we count on the courts to do right? It was the Supreme Court after all who okayed Jim Crow and separate but equal. It was another Supreme Court that decided the Dred Scott case.

Yes, that's true. The courts are not always on their best behavior but they tend to be more accurate; forward thinking and fair than society as a whole.
