Who has the burden of proof? Does Obama have the burden of proving he is a "natural born" citizen or do his challengers have the burden of proving otherwise. Since his challengers are bringing the suit, it seems to me they have the burden of proof. The certificate of live birth would at least create a presumption that Obama was born in the US. Obama's challengers have no credible evidence to overcome that presumption. The next issue is whether an ordinary citizen has "standing" to bring such a suit. Probably not because they can show no special injury.

Re: "then I simply obtained a subpoena duces tecum"

I highly doubt that the U.S. Supreme Court will have any problem at all obtaining the information they require. :-)

(However... if you believe that you have some legal way as an individual to get around the State's privacy laws... then you should 'have at it' I guess!)

PS --- what did you think of the claimant's wonky 'evidence' or 'legal theory'?
