I commented elsewhere that Roberts, Scalia, Thomas and Alito are likely to rule in favor of the Constitution and let the chips fall where they may, but that Kennedy is unlikely to go to the mat for the Constitution if it might be unpopular. The liberals don't give a tinkers damn what was written a couple hundred years ago, this is a chance for a shift in power.

The Supreme Court has just refused to hear the case.
