I didn't mean to be rude. I can see that you want to go on with the discussion and would ask one question after another. I have no interest in the case you are discussing. During the course of an investigation if a false affidavit was created, than naturally it would be part of the indictment. In the case of conspiracies and other inchoate crimes there are so many opportunities to charge that many charges are simply used as leverage for plea bargains. So it is left to the prosecutor to select who gets what out of his/her arsenal of charges.

False swearing, false police reports etc are likely to be dropped for corruption charges like Official Misconduct, Miscoduct in Office or similar statutes that carry heavier penalties due to their violation of the public trust.
