That is the question the law suit raised.

(It *also* argued that John McCain was not a "natural born citizen" either... and the Socialist Party candidate was not a natural born citizen --- so it sought to have all three candidates disqualified by the Supreme Court from the Presidency....)

However, under our system of governance there is no higher avenue for legal appeal than the Supreme Court.

So, after they dispose of a case there is nowhere left for the case to go.
