Intel hearing on Digital case postponed

SAN FRANCISCO, Oct 22 (Reuters) - Intel Corp said that the first hearing in its suit against Digital Equipment Corp (DEC) has been postponed until October 30 by the court.

The hearing had been scheduled to take place in San Jose, Calif. in U.S. District Court Thursday afternoon. It would have been the first time the sparring companies would have faced each other in court since Digital sued Intel in May.

In May, Digital sued Intel for patent infringement, alleging that Intel has infringed on 10 Digital patents.

Later in May, Intel filed a suit of its own, asking that Digital return secret Intel documents in its possession. An Intel spokesman in Santa Clara, Calif., said that the case had been continued to October 30 by the court because of its calendar. He declined to comment on recent analysts' predictions that the two companies are close to reaching an agreement to settle the suit.

Wednesday, Ashok Kumar, an analyst with Loewenbaum & Co Inc said that an out-of-court settlement between the two companies is ''imminent,'' and was possibly expected as soon as Wednesday.

A Digital spokesman could not be immediately reached.
