It isn't.


To be clear, Congress can pass legislation that will require the FCC to reinstate it whether the FCC likes it or not. And both Reid and Pelosi have talked about doing it. Which is why the Right is nervous, understandably, about it.

Whether Obama would sign the legislation or not, who knows. Obama could, if he chose to do so, make it happen without legislation. He has said he doesn't favor that, but he has waffled on so many issues one can have no confidence.

It is such an affront on the Constitution that the discussion of it should be taken seriously, even if one believes it isn't likely to happen.
