You got it wrong even on your justification... Gonzales et al, war criminals all, used the term "Unlawful Combatants" (Reagan started it that argument). I.e. AQ combatants were to be considered like mercenarys and therefore not eligible for POW status... There was a court ruling recently in the USA that turned down that argument. It's all up in the air and there's a big stink out there that the Geneva Conventions, the UN Convention against Torture, US Military law ALL were violated by the Bush Administration. You don't even know that the Bush Administration changed the definition of Torture (But a Duck is still a Duck, if it quacks etc..). I think you're so hung up on defending the indefensible because it was done by your POTUS. You're standing on very low moral grounds.

Incidently UN CAT is applicable to ALL, including Al Qaida members, even GWB is covered (imagine that!).
