On Nov24 ARQL was able to get off the DT coming from its May2007 H of $10.59 and it was bale to gain 56.66% from the $3 level until it found resistance at the $4.70 on Dec19

However,the insiders have been consistent buyers since May.:>)

The stock was up 11.86% today on volume of 135,834 about 140Ks below its ADV.It has resistance from $4 to $4.50 before it can test its Dec H.

ARIA was up 10.36% at its intraday H and is still up 8.54% at present.<g>

The nearest resistance is now the March 18 H at $3.70 and then the March 17 H at $3.92 <g>

Yesterday it announced that the Federal Circuit Court has ruled in favor of LLY following an en banc rehearing in Dec.

The rehearing concerned a 2007 judgment that held LLY liable for infringement of four claims on an ARIA patent,but the four patent claims were ruled invalid due to inadequate written description.<g>

The co-plaintiffs include Harvard University, the Massachusetts Institute of Technology and the Whitehead Institute for Biomedical Research. Together with ARIA, they had sued LLLY and had prevailed at an initial trial.<g>

Now ARIA said that they are reviewing the ruling by the Federal Circuit Court to assess their options in the case.
I have some bad memories from the time that the FL Supreme Court had an en banc ruling against me on a case,due to some 'technicalities'. :<(

The Patents that were issued in 2002, is based on the discoveries made by research groups led by Professors David Baltimore, Phillip Sharp and Tom Maniatis at MIT and the Whitehead Institute for Biomedical Research and Harvard University, and ARIA is the exclusive licencee.

ARIA has been able to trim some of its losses in the last 3Qs in spite of 17% lower revenues on the last Q.
The EL for 2010 is around $0.60 vs. $0.82 in 2009 and for 2011 a further trim on the loss to around $0.35 is expected.<g>

The stock traded last week at its highest level since Feb 2008. I still have fond memories of ARIA in 2000 when the stock went from $12 to $40 in one day.<G>
