I read your posting about the shorting of shares of SLV. I presume the shorter has short sold borrowed shares. In what respect is this different than any other legal short sale of common shares ?

The prospectus might well say that they will hold silver to back up all shares issued by/from its treasury. But does it say that treasury shares may not be loaned to investors who wish to short them ? My memory says that it is common knowledge that these common shares may be shorted. Again, please explain why this situation is different than the shorting of other shares of common stock. Have I missed your point ?
