Among the issues the agency is looking into are whether EduCap used a $28 million Gulfstream IV corporate jet owned by the nonprofit for trips not related to its core mission, according to records in U.S. District Court here. EduCap used this jet to provide trips for Mr. Daschle and other prominent figures. Some of the trips have been reviewed by the IRS, and in a separate investigation by the Senate Finance Committee. A lawyer from Skadden, Arps, Slate, Meagher & Flom LLP who represents EduCap declined to discuss the IRS case. Mr. Daschle's decisions to take two trips on the EduCap jet, one to the Bahamas and another to the Middle East, were questioned by the Senate Finance Committee as potentially taxable income in the context of the panel's broader review of Mr. Daschle's finances. Mr. Daschle said the trips weren't taxable, but withdrew his nomination Tuesday before the issue was resolved. The Senate Finance Committee had planned to release a report on its Daschle investigation that contained details of who took flights on the EduCap jet, aides to the committee said Tuesday. But committee Democrats moved to keep the report under wraps after Mr. Daschle announced he would withdraw his nomination, those people said. A committee spokeswoman said the panel didn't release a final report on Mr. Daschle because his withdrawal as a nominee made the report moot.
