Ogden seems to embrace the idea of a “living, breathing” Constitution

The doctrine commonly called "the living constitution", or at least the more extreme versions of it, should be called "the dead constitution", because if the constitution is whatever the judges would like it to say, or wish it had said, then it is close to meaningless, far more of a dead issue than a living one.
