I just read the news report about Nomai and Iomega. The most interesting sentence is this one, IMO: "In its complaint filed in California, Nomai is seeking a declaratory judgment of non-infringement and invalidity of certain United States patents issued to Iomega, noninfringement of trade dress, trademark and copyright, and non-unfair competition and non-misappropriation of trade secrets."

So now Nomai is claiming not that they haven't infringed upon Iomega's patents, but that the patents are invalid. Much tougher thing to get a court to agree to, I would bet.
