Use Clean's suggestion only after all else has failed.

I meant to raise hell in a nice way but don't let Apple play the sorry you're screwed card like they try to do frequently. I can see them refusing to replace an iPod that has physical damage like dents on the back but a faulty install disk should be covered. All they have to do is burn a new copy which they could do at the Genius bar.

Take the issue straight to a manager or recall the phone support and escalate the issue to a supervisor.

Worst case is you will have to pay $19.95 for a replacement DVD which will come with a higher system version like 10.5.5
