As expected Avant will use every procedural tool available to delay the final resolution of this case. You can't really blame them, since they are delaying the inevitable. In the ordinary course, one would expect CDN to respond with a request for an expedited appeal (or whatever the California equivalent is). Unfortunately this kind of gamesmanship is the norm and brings all lawyers (and the law) into disrepute. This delay will give Avant a lot of time to formulate corporate strategies and new products to lessen the impact of the eventual decision. "Justice delayed is justice denied".

AVNT. Yes that is what I was referring to. I believe that AVNT filed thier request for a rehearing on or around Oct 7th. I would have thought that the panel would have looked at the request and sent the injunction back to Judge Whyte, dismissing AVNT's request quite quickly. I'm very surprised that we haven't heard anything yet on AVNT's appeal. I haven't read AVNT's arguement yet but I'm trying to get a copy of it. Anyone seen or read it yet? Thank for Asensio's comments. He hasn't had any on his web page on this delay.
