Change we can believe in. the press touts him as a brilliant constitutional lawyer, he criticizes his predecessor's position and now adopts it. You can't make this up. No one would believe you.

The problem is not political. It's constitutionally complex.

In order to have jurisdiction over the detainees, they need to be on US soil. Guantanamo is leased from Cuba, so if they deemed they had the right of Habeas Corpus, they would be in effect annexing that territory from Cuba.

This issue was brought up in the WSJ about 4-years ago.

As a result, the ruling appears correct regardless of ideology according to the laws and the US Constitution.
