The difference is the existence of a clear legal precedent for the use of water torture being a war crime. BTW define "OK", it's definitely a term from the Department of Fuzzy Thinking. Killing people is always "OK" in the sense so many members of our species seem to like doing it a great deal and find it to their advantage to do so, under many circumstances homicide is legally sanctioned with social rewards given to successful practitioners thereof.
