1. We are not in a revolutionary war against people who may or may not be terrorists...mostly not. What century are you living in? Are you crazy?

2. The courts say all kinds of stupid things because the courts are full of, you know, human beings. The warrantless wiretapping was clearly illegal and, even more ridiculously, unnecessary as FISA courts regularly handed out warrants like tic tacs.
