again.... you oppose my suggestion to live under a system where loser pays all fees...

READ: the attorney STILL gets paid... (either way)

the contingency option is for the attorney to CHOOSE, (not an obligation), hence, the premise continues to work, if he so chooses, he ought to analyze the case carefully....
